Please read these Terms of Use carefully before using this website or engaging with any Wyse Wellness Collective services. By accessing our website, submitting a consultation request, or enrolling in any program, you agree to be bound by these terms.

1. About Wyse Wellness Collective

Wyse Wellness Collective (“we,” “our,” or “us”) is a personal development and mindset coaching practice operated by Heather Wyse, based in the State of Nevada. Wyse Wellness Collective offers 1:1 coaching, group programs, digital products, and educational content designed to support clients in expanding their capacity, well-being, and aligned living.

2. Nature of Services — Not Therapy or Medical Advice

This is one of the most important sections of these Terms. Please read it carefully.

Wyse Wellness Collective provides coaching services, which are distinct from licensed mental health therapy, psychological counseling, psychiatric treatment, and medical advice. Heather Wyse is a certified coach, not a licensed therapist, psychologist, psychiatrist, or medical professional.

Coaching is a collaborative, forward-focused relationship that supports personal growth, mindset development, and intentional living. It does not diagnose, treat, or cure any mental health condition, medical condition, or psychological disorder.

By engaging with Wyse Wellness Collective services, you acknowledge and agree that:

  • You are not seeking and will not receive therapy, counseling, or medical treatment
  • Wyse Wellness Collective services are not a substitute for professional mental health or medical care
  • If you are experiencing a mental health crisis, medical emergency, or require clinical support, you will seek care from a licensed professional
  • Results from coaching are not guaranteed and depend on your own commitment, effort, and circumstances

3. Free Consultation

Wyse Wellness Collective offers a complimentary consultation as an introductory conversation for prospective clients. The following terms apply to all consultations:

PurposeThe consultation is a mutual exploration to determine whether coaching is the right fit for you and whether Wyse Wellness Collective is the right coach for your goals. It is not a coaching session, therapy session, or commitment of any kind.
AvailabilityConsultations are offered at Wyse Wellness Collective’s discretion and do not guarantee enrollment in any program or availability of coaching services.
One Per PersonThe complimentary consultation is limited to one per individual. Repeat requests may be declined.
Right to DeclineHeather Wyse reserves the right to decline to work with any prospective client, at any time, for any reason, without obligation to provide explanation.
No AdviceInformation shared during a consultation does not constitute professional coaching advice, therapeutic guidance, financial advice, or legal counsel.

4. Payment & Refund Policy

4a. Payment

Payment for Wyse Wellness Collective programs, packages, and digital products is due at the time of enrollment or as specified in your individual coaching agreement. All prices are stated in US dollars. Wyse Wellness Collective reserves the right to update pricing at any time; changes will not affect agreements already in place.

4b. No-Refund Policy

Wyse Wellness Collective maintains a strict no-refund policy. Please review this carefully before making any purchase or signing any coaching agreement.

All sales are final under the following conditions, whichever occurs first:

  • A coaching agreement or program contract has been signed
  • Payment has been processed

Once either of the above conditions is met, no refunds, credits, or transfers will be issued, regardless of whether sessions have been used, program materials have been accessed, or personal circumstances have changed.

This policy exists because Wyse Wellness Collective invests significant time, resources, and preparation into each client relationship from the moment of commitment. We encourage all prospective clients to use the complimentary consultation to ensure coaching is the right fit before enrolling.

Exceptions to this policy will not be made except where required by applicable law.

5. Intellectual Property

All content on the Wyse Wellness Collective website and within Wyse Wellness Collective programs — including but not limited to frameworks, course materials, written content, worksheets, videos, audio recordings, and brand assets — is the exclusive intellectual property of Wyse Wellness Collective and is protected by applicable copyright and trademark law.

You may not:

  • Reproduce, copy, or redistribute any Wyse Wellness Collective content without prior written consent
  • Share, resell, or sublicense program materials to any third party
  • Use Wyse Wellness Collective frameworks, methodologies, or brand elements for commercial purposes
  • Screenshot, record, or distribute any live or recorded program sessions

Personal, non-commercial use of content for your own growth and reference is permitted.

6. Client Responsibilities

By engaging with Wyse Wellness Collective services, you agree to:

  • Engage honestly and in good faith throughout the coaching relationship
  • Take responsibility for your own decisions, actions, and outcomes
  • Communicate openly if your needs change or if the coaching relationship is not serving you
  • Maintain the confidentiality of any group program content or fellow participants’ disclosures
  • Treat Heather Wyse and any Wyse Wellness Collective team members with respect

Wyse Wellness Collective reserves the right to terminate a coaching relationship if a client engages in abusive, threatening, or otherwise inappropriate behavior, without refund obligation.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Wyse Wellness Collective and Heather Wyse shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or participation in any Wyse Wellness Collective program, including but not limited to loss of income, emotional distress, or failure to achieve desired outcomes.

Our total liability to you for any claim arising from your use of Wyse Wellness Collective services shall not exceed the total amount you paid to Wyse Wellness Collective in the three months preceding the claim.

8. Disclaimer of Warranties

This website and all Wyse Wellness Collective services are provided on an “as is” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content, program, or service offered by Wyse Wellness Collective. We do not guarantee any specific results from coaching.

9. Website Use

By using this website, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of others. You may not:

  • Attempt to gain unauthorized access to any part of the website or its systems
  • Use the site to distribute spam, malware, or harmful content
  • Scrape, harvest, or collect data from the site without written permission

Wyse Wellness Collective reserves the right to restrict or terminate access to the website for any user who violates these terms.

10. Third-Party Links

This website may contain links to third-party websites or platforms. These links are provided for convenience only. Wyse Wellness Collective does not endorse, control, or accept responsibility for the content or practices of any linked site. Your use of third-party sites is governed by their own terms and policies.

11. Governing Law & Disputes

11a. Choice of Law

These Terms of Use are governed exclusively by the laws of the State of Nevada, without regard to conflict of law principles. By engaging with Wyse Wellness Collective services — regardless of where you are located — you expressly agree that Nevada law governs this agreement and that you waive any right to assert the laws of your home state or jurisdiction as controlling.

Any dispute arising from these terms or your use of Wyse Wellness Collective services shall be resolved in the state or federal courts located in Clark County, Nevada. You expressly consent to personal jurisdiction in those courts and waive any objection based on venue or inconvenient forum.

11b. Geographic Scope & Client Responsibility

Wyse Wellness Collective services are intended for residents of the United States. By engaging with Wyse Wellness Collective, you represent that your participation in coaching services is lawful in your jurisdiction and that you have determined that coaching services of this nature are permitted where you reside.

Clients located outside the State of Nevada — including residents of states with distinct consumer protection laws such as California and Washington — acknowledge and agree that:

  • Nevada law governs this agreement as stated in Section 11a, and you have expressly consented to this choice of law
  • You are responsible for understanding any additional legal requirements that may apply to you based on your location
  • Wyse Wellness Collective makes no representation that its services, website, or these Terms comply with the laws of any jurisdiction outside Nevada
  • If any provision of these Terms is unenforceable under the law of your jurisdiction, that provision shall be modified only to the minimum extent necessary to make it enforceable, and all remaining provisions shall remain in full force

California Residents: To the extent California law requires specific disclosures or rights beyond those stated in these Terms or our Privacy Policy, you may contact us at heather@wysewellnesscollective.com to make any applicable request. We will respond within 30 days.

11c. International Clients

Wyse Wellness Collective services are not directed at individuals outside the United States. If you are located outside the US and choose to engage with Wyse Wellness Collective, you do so at your own initiative and are solely responsible for compliance with applicable local laws, including but not limited to data privacy laws such as the EU General Data Protection Regulation (GDPR), Canada’s PIPEDA, or the UK GDPR. Wyse Wellness Collective makes no representation that its services are appropriate or available for use outside the United States.

11d. Informal Dispute Resolution

Before initiating any formal legal proceeding, you agree to contact Wyse Wellness Collective in good faith to attempt to resolve the dispute informally. Wyse Wellness Collective will make reasonable efforts to address your concern within 30 days of receiving written notice at heather@wysewellnesscollective.com.

12. Updates to These Terms

Wyse Wellness Collective reserves the right to update or modify these Terms of Use at any time. When changes are made, the revised terms will be posted to this page with an updated effective date. Your continued use of the website or Wyse Wellness Collective services following any update constitutes acceptance of the revised terms.
